Welcome to Dartist! These Terms of Service govern your use of the Dartist app. By using the app, you agree to these terms.

1. Scope

These Terms of Service apply to the mobile application "Dartist" (hereinafter "App") provided by Bastian Bischler (hereinafter "Provider", "we", or "us").

By downloading, installing, or using the App, you agree to these Terms of Service. If you do not agree, you may not use the App.

2. Description of the App

Dartist is a darts scoring application that supports various game modes:

• X-01 (301, 501, 701)
• Cricket
• Around the World
• Bob's 27
• Challenge Mode
• Checkout Practice

The App also offers commentary features, statistics, and optional cloud synchronization.

3. Usage Requirements

3.1 Minimum Age

You must be at least 16 years old to use the App. If you are under 18, you confirm that you have parental or guardian consent.

3.2 Technical Requirements

• iOS 12.0 or later / Android 5.0 or later
• Internet connection for optional online features

4. User Accounts

4.1 Registration

Some features require a user account. You can register via:

• Email and password
• Google Sign-In
• Apple Sign-In (iOS)

4.2 Account Security

You are responsible for your account security:

• Keep your login credentials confidential
• Notify us of any unauthorized access
• Use a strong password

4.3 Account Deletion

You can delete your account at any time in the App under: Settings → Account → Delete Account. All data will be permanently deleted.

5. Free and Paid Features

5.1 Free Features

The basic version of the App is free and includes:

• All game modes
• Local game storage
• Basic statistics
• One commentator

Free users see advertisements.

5.2 Dartist Pro

The Pro subscription offers additional features:

• No advertisements
• All commentators unlocked
• Cloud synchronization
• Unlimited game history

6. In-App Purchases and Subscriptions

6.1 Available Options

Prices may vary by region and include applicable taxes.

*Lifetime access grants use of Pro features for as long as the App is offered in the respective app store and supported by the Provider.

6.2 Payment Processing

All purchases are processed through the respective app store (Apple App Store or Google Play Store). Their payment terms apply.

For iOS users: In addition to these terms, the Apple Licensed Application End User License Agreement also applies. Payment will be charged to your Apple ID account at confirmation of purchase.

6.3 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

6.4 Cancellation

You can cancel subscriptions at any time:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Google Play Store → Menu → Subscriptions

After cancellation, Pro features remain active until the end of the paid period.

6.5 Refunds

Refunds are handled according to the respective app store policies:

• Apple: Apple Refund Policy
• Google: Google Play Refund Policy

7. Referral Program

7.1 How It Works

You can share your personal referral code with others. When a new user uses your code and qualifies (at least 3 games within 7 days), you receive rewards.

7.2 Rewards

• 3 successful referrals: Additional commentator
• 10 successful referrals: Full Pro access

7.3 Prohibited Practices

The following practices are prohibited:

• Self-referrals
• Creating multiple accounts to abuse the program
• Automated or fraudulent referrals

We reserve the right to revoke rewards and suspend accounts for violations.

8. Intellectual Property

8.1 Our Rights

All rights to the App, including design, code, graphics, sounds, and text, belong to us or our licensors.

8.2 Limited License

We grant you a limited, non-transferable, revocable license for personal use of the App.

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the source code
• Use the App commercially without our permission
• Remove or alter proprietary notices

9. Code of Conduct

When using the App, you agree to:

• Not distribute illegal content
• Not introduce malware
• Not manipulate or hack the App
• Not use false identities
• Not harass other users

10. Availability and Changes

10.1 Availability

We strive to keep the App available at all times but cannot guarantee uninterrupted availability. Maintenance or technical issues may cause temporary outages.

10.2 Changes

We reserve the right to modify, expand, or limit the App and its features at any time. We will inform you of significant changes in advance.

11. Limitation of Liability

11.1 Unlimited Liability

The Provider is fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

11.2 Limited Liability for Slight Negligence

In cases of slight negligence, the Provider is only liable for breach of a material contractual obligation (cardinal duty). In such cases, liability is limited to foreseeable damages typical for this type of contract at the time of contract conclusion.

11.3 Data Loss

As the App is primarily designed as an offline application, the user is responsible for regularly backing up their data. The Provider is not liable for loss of locally stored data (e.g., game progress) if the user does not utilize the optional cloud synchronization features or has not created their own backups.

11.4 State of Technology

The App is provided according to the current state of technology. 100% error-free software cannot be technically guaranteed.

12. Indemnification

You agree to indemnify us against all third-party claims arising from your use of the App in violation of these terms.

13. Termination

13.1 Termination by You

You can terminate your use of the App at any time by uninstalling the App and deleting your account.

13.2 Termination by Us

We may terminate or restrict your right to use the App if:

• You violate these terms
• You abuse the App
• Legal requirements demand it

14. Changes to Terms of Service

We may modify these Terms of Service. We will notify you of significant changes in the App or via email. Continued use of the App after changes constitutes acceptance of the new terms.

15. Final Provisions

15.1 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

15.2 Jurisdiction

To the extent permitted by law, the place of jurisdiction is the Provider's place of residence.

15.3 Severability

If any provision of these terms is invalid, the validity of the remaining provisions remains unaffected.

15.4 Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the complete agreement between you and us.
